These Terms & Conditions (“Terms”) govern your use of Tobermory Grocery Run (“TGR”, “we”, “us”, “our”) and any orders, deliveries, errands, pickups, and related services (the “Services”). By placing an order, you confirm you have read and agree to these Terms.

Important: Cancellation policy
Orders may be cancelled online only before the run cutoff time. Cancellations after cutoff may still require payment of service/delivery fees, or a $75.00 cancellation fee (to discourage last-minute cancellations). The applicable cutoff time is shown on the website’s run status area.

1) Service description

TGR provides a local-run delivery and errands service. Services may include grocery shopping, pickups from participating retailers, and other errands offered from time to time. Availability varies by run, time, location, road conditions, and capacity.

Runs operate on scheduled days with order cutoffs. A run has a maximum number of available slots. Once a run is full or past cutoff, ordering is closed. Cutoffs and slot availability displayed on the site are the source of truth.
Current cutoffs (subject to change)
  • Local Saturday delivery: cutoff is typically Thursday (displayed cutoff time applies).
  • Owen Sound Sunday run: cutoff is typically Friday (displayed cutoff time applies).
If the cutoff shown on the website differs from the typical schedule above, the website cutoff applies.

4) Fees, grocery totals, and payment

Fees are separate from grocery totals. Fees generally cover service time, delivery distance, run logistics, and selected add-ons. Grocery totals reflect store receipts and availability.
Order ID requirement
When making payments, you must include your Order ID in the payment note so we can match payments correctly.

5) Substitutions

Store stock changes constantly. You choose a substitution preference at checkout. If you request contact for substitutions, delays may occur if you cannot be reached.

6) Cancellation policy

Cancellation rules are designed to protect limited run capacity and avoid wasted driving/shopping time.

For clarity: “Cutoff” is the last time you can cancel without triggering the after-cutoff policy. The cutoff time is shown on the website’s run status display.

If TGR offers pickup/delivery of regulated or restricted items, it will be done only where permitted by applicable law and store policies. We may require valid government ID and in-person handoff. We may refuse delivery if ID or eligibility cannot be confirmed.

9) Accuracy, disputes, and chargebacks

10) Limitation of liability

To the maximum extent permitted by law, TGR is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the Services will not exceed the service/delivery fees paid for the specific order at issue.
Nothing in these Terms limits rights that cannot be limited under applicable consumer protection laws.

11) Privacy and data

We store customer profile information and order data to provide the Services, communicate about orders, and maintain records. You consent to this storage when creating an account/profile and placing orders.

12) Refusal of service

We may refuse or cancel service where necessary for safety, legal compliance, abusive conduct, suspected fraud, or repeated violations of these Terms.

13) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version.

14) Governing law

These Terms are governed by the laws of Ontario and the applicable laws of Canada.
